Comprehensive Legal Agreement for Service Usage
By registering for and/or using the services provided by Nexbyet Services LLP ("Company", "we", "us", or "our"), you ("Client", "User", or "you") agree to be bound by the terms and conditions set forth herein. If you do not agree to these terms, you are prohibited from utilizing our services.
We will set up your account after we have received payment and we and/or our payment partner(s) have screened the order(s) in case of fraud. It is your responsibility to provide us with an email address which is not at the domain(s) you are signing up under. If there is ever an abuse issue or we need to contact you, the primary email address on file will be used for this purpose.
All services provided by Nexbyet Services LLP may only be used for lawful purposes. The laws of the State of Gujarat, and the Union of India apply.
The customer agrees to indemnify and hold harmless Nexbyet Services LLP from any claims resulting from the use of our services. Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work.

You agree to supply appropriate payment for the services received from Nexbyet Services LLP, in advance of the time period during which such services are provided. You agree that until and unless you notify Nexbyet Services LLP of your desire to cancel any or all services received, those services will be billed on a recurring basis.
Late payments may result in account suspension and eventual termination. Nexbyet Services LLP reserves the right to change the monthly payment amount and any other charges at anytime with 30 days written notice to the customer.
Your use of this service is at your sole risk. Our backup service is provided as a courtesy to our shared hosting customers. Nexbyet Services LLP is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on Nexbyet Services LLP servers.
If your shared hosting server has a physical downtime that is not within the 99.9% uptime you may receive one month of credit on your account. Approval of the credit is at the discretion of Nexbyet Services LLP dependent upon justification provided. Third party monitoring service reports may not be used for justification due to a variety of factors including the monitor's network capacity/transit availability.
Customers may cancel at any time via a cancellation request form in the client area. Nexbyet Services LLP reserves the right to cancel, suspend, or otherwise restrict access to the account at any time with or without notice for any violation of these Terms.
In no event shall Nexbyet Services LLP, its directors, employees, or partners, be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the services, even if we have been advised of the possibility of such damages.
These Terms shall be governed by and construed in accordance with the laws of the State of Gujarat, India, without regard to its conflict of law principles. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Junagadh, Gujarat.
Nexbyet Services LLP reserves the right to revise its policies at any time without notice.
